Booking terms & privacy
The fine print, in plain English

About these terms
These terms apply to every booking with David Hera Photography. I send them with your quote, and your booking is confirmed once you’ve agreed to them in writing and paid the deposit.
Booking and payment
A 30% deposit secures your date. The balance is due 14 days before a wedding, or within 7 days of invoice for other shoots.
No GST is charged, so no GST is added to any price.
Changes, postponements and cancellations
If you need to move your date, your deposit transfers to a new date within 12 months, as long as I’m available.
If you cancel, the deposit isn’t refunded because I’ve held the date for you. Anything else you’ve paid is refunded.
If illness or an emergency stops me from photographing your booking, I’ll arrange a photographer I trust to cover. If that isn’t possible, you get a full refund of everything you’ve paid.
Outdoor portrait, couples and promo sessions can be rescheduled at no cost if the weather is unsuitable.
Delivery
Photos are delivered as edited, high-resolution JPEGs in a private online gallery. Typical turnaround: a wedding sneak peek within 72 hours and the full gallery within 4 weeks; portraits within 2 weeks; headshots within 7 days; events within 5 working days; a web-ready concert selection within 48 hours.
Galleries stay online for at least 12 months. Please download and back up your photos. RAW files aren’t supplied.
Copyright and how you can use your photos
Under the Copyright Act 1994, whoever commissions and pays for photographs owns the copyright unless agreed otherwise. By booking, you agree that David Hera keeps the copyright in the photos, and you receive a licence to use them.
Weddings, couples, portraits and prints come with a personal licence: print, share online and give copies to family and friends.
Headshots, personal branding, events, concerts and promo shoots come with a business licence: websites, social media, press and marketing for you, your organisation, and for concerts the artist, venue and promoter.
Neither licence covers selling the photos, entering them in competitions or using them in paid advertising for third parties. Ask if you need wider rights.
Portfolio use
I may share a selection of photos from your shoot in my portfolio, on social media and in photography competitions. If you’d rather I didn’t, tell me when you book and your photos stay private, at no extra cost.
Guests and children
For weddings and events, please let guests know a photographer will be there. I’ll remove any photo of a guest who asks.
Photos of children are only shared publicly with the consent of a parent or guardian.
Liability
I back up your photos in more than one place as soon as practical after the shoot. If photos are lost or damaged for reasons beyond my control, my liability is limited to a refund of what you’ve paid.
Privacy
When you send an enquiry, I collect your name, contact details and what you tell me about your shoot. I use this only to reply, quote and deliver your booking. It’s kept in my email and business records and isn’t sold or shared, except that enquiry emails are delivered through Resend, an email delivery service.
